What documents need to be served on the Supreme Court?

Supreme Court only needs to be served with four (4) copies of briefs and petitions for rehearing. (Cal. Rules of Court, rule 8.44(b)(1).)

What documents need to be served on the superior court?

Superior court only needs to be served with one (1) copy of briefs (Cal. Rules of Court, rule 8.212(c)) and petitions for writ (Cal. Rules of Court, rule 8.490(f)).

How do I file an address change?

When you change your address, you must serve the other parties and file notice (original plus 1 copy) of your change of address with the Court of Appeal. (Cal. Rules of Court, rule 8.32) The clerk's office may not accept filing from you if your address on the document does not match your address of record. Also, you may experience a delay in receiving documents mailed by the court.

Does the 2nd Dist. have local rules?

Yes. The local rules of court for the Court of Appeal, Second Appellate District are contained within the California Rules of Court under the section in the bound volume titled "California Courts of Appeal: Internal Operating Practices and Procedures." What are the Rules of Court?
Where can I find the Rules of Court?

The California Rules of Court (Cal. Rules of Court) are rules that govern the general procedures for preparing and filing various documents. Most law libraries will have a copy of them. The rules are also available online at http://www.courtinfo.ca.gov/rules/.

Who can file documents?

Only counsel of record or a self-represented party may file a document in the appeal. If counsel is being substituted, the substitution of attorneys must be served and filed before any documents can be accepted from the new attorney. The substitution of attorneys must be signed by the retiring counsel, new counsel, and client, and it must be accompanied by a proof of service on all parties when presented for filing. (See Cal. Are settlement conferences available?

Yes, the Second Appellate District participates in a courtwide voluntary settlement program conducted before the date by which the record must be filed. Please click here for more information.

Do documents need to be blue-backed?

Documents do not need to be blue-backed.

Can I overnight documents?

You may overnight your documents to be filed via any company guaranteeing next day delivery. However, rule 8.25(b)(3) only applies to briefs as defined in rule 8.25(b)(4). View all Rules of Court.
